Mr. Jones, managing partner in the Falls Church office, focuses his practice in the insolvency area, regularly dealing with financial restructuring, distressed asset transactions, business turnarounds, and bankruptcy law, including related litigation.  His experience includes representing all major constituencies in the distressed business arena, including companies and their owners, directors and officers, ad hoc and official committees, trade creditors and vendors, and court-appointed fiduciaries.

Mr. Jones has worked with clients in a variety of industries including commercial real estate, retail, automotive, government contracting, mortgage lending, consumer electronics, hospitality, convenience store, construction, and electrical contracting.  He has been involved in many of the “mega” chapter 11 cases filed in the Richmond Division, including Toys “R” Us, Gymboree, LandAmerica Financial Group, Circuit City Stores, RoomStore, Inc., and Heilig-Meyers Corp.  Mr. Jones has also represented bankruptcy trustees and liquidating agents in a variety of litigation matters.  In addition to his work in the insolvency arena, Mr. Jones also has trial experience in commercial litigation matters in federal court.

Rewarding Good Behavior: Courts Should Approve Exculpation for the Pre-Petition Conduct of RSA Parties

The rationale for exculpation is straightforward: if you contribute to or participate in the debtor’s reorganization efforts, you should not face liability for your good-faith efforts.  This protection fosters a fair, transparent restructuring process by reducing barriers to entry and incentivizes stakeholders to play a part in the development of a confirmable plan.  Without exculpation, key creditors and competent professionals may shy away from the bankruptcy process, which would undermine the main purpose of chapter 11–achieving a successful restructuring.

Five Things You Need to Know About Your Customer in Bankruptcy

This year has presented unique challenges for business owners and management.  The economic crisis caused by the COVID-19 pandemic has driven people to work remotely, caused companies to curtail capital spending and hiring, and even led to reductions in force.  Additionally, the pandemic has pushed many distressed businesses over the edge and into bankruptcy, resulting in a sharp increase in Chapter 11 commercial bankruptcy filings. According to data compiled by Epiq Systems, Inc., the number of Chapter 11 commercial bankruptcy cases filed through October 2020 (6,081 cases) exceeded the total for all of 2019 (5,519 cases).  For many businesses, having a customer, client, or contract-counter party file for bankruptcy will be a reality if it hasn’t happened already.  This article will highlight various aspects of bankruptcy law and provide some practical pointers for a business dealing with a bankrupt business partner (“Customer”).

Unwanted Disclosure: New Chapter 11 Rules Require Law Firms To Reveal All Their Fees

...The new guidelines "will require bankruptcy lawyers to do things that we have not necessarily done before," said Chirstopher A. Jones in Falls Church. "This is a new level of administrative burden and, depending on the size and complexity of the case, could be very significant."

...Jones estimated that over the last five years in Virginia, no more than 10 cases would qualify, leaving the existing fee guidelines in place for the remaining majority of Chapter 11 cases.

King, the Chapter 7 Bankruptcy Trustee of Rowe Furniture, Inc., and Guy A. Davis, the Chief Liquidation Officer of bankrupt Storehouse, Inc. and the Liquidating Trustee of The Rowe Companies.
